Accomplishments

Appellate—Family Law—Past Due Child Support
Reversed Judge’s decision to vacate child support arrears owed for over 30 years. Client was divorced in 1976 and husband had a long history of refusing to pay child support. After 30 years, husband filed an action to vacate any child support arrears arguing the mother secreted the child out of Colorado and the statute of limitations for enforcing the judgment had expired. The Court ruled in favor of the husband. We filed a Petition for District Court review and reversed the Magistrate’s decision.

Personal Injury—Automobile Accident
Recovered damages from Arapahoe County caused by a Police Officer. Client was rear-ended by an Arapahoe County Sheriff. Arapahoe County denied liability and refused to reimburse Client for his medical expenses and moved to dismiss the complaint. After pressuring the County, the motion to dismiss was retracted and the County accepted liability.

Civil Defense—Property Damage
Dismissed case involving over $30,000 in damage to an apartment complex. Clients were accused of causing extensive damage to their apartment. The insurance company filed suit; however, after a thorough investigation, we drafted a letter detailing the weaknesses in the case and demanded dismissal. After several phone calls, the law firm representing the insurance carrier dismissed the case.

Civil Defense—Past Medical Bills
Dismissed case involving $75,000 in past medical bills. Client was uninsured when she became involved in a drinking-and-driving accident. The hospital demanded repayment of over $75,000 in past medical bills. Client was unemployed and unable to pay for any of the damages. We drafted a letter demanding dismissal arguing the statue of limitations had expired. After several phone calls, the attorney representing the hospital dismissed the matter.

Family Law—Custody
Obtained 50/50 custody for a man accused of sexually assaulting his two year-old son. A group of play therapists and other professionals were convinced the child’s play themes indicated that his father sexually assaulted him. The child family investigator recommended supervised visits only after an offense specific evaluation was completed. We successfully petitioned the court to appoint a child custody evaluator who discovered the child’s play themes were not indicative of sexual assault, but, instead, the child was acting out his favorite children’s movie. The trial lasted 3 days with 13 witnesses and the court issued a 38 page opinion granting father graduated 50/50 parenting time as his parenting time had been suspended for the previous 8 months.

Civil Prosecution—Real Estate
Successfully recovered over 30 acres of real estate in Boulder County. Client had previously declared bankruptcy twice prior to discovering the property. The property was transferred to Client by his father over twenty years ago. Client only recently became aware of one parcel. In the process of our investigation, we discovered five additional properties throughout Boulder County and filed an action to quiet title. Client was able to sell the property and significantly improve his financial status.

Criminal Defense—Violation Of Restraining Order
Dismissed charge for violation of a restraining order. Client was charged with violation of a restraining order due to drinking alcohol. Several times Client admitted to police he was aware he violated the restraining order. After consultation with the District Attorney, the case was dismissed.
